Terms and Conditions of the AsiaTrip.pl Service
General Provisions
- These terms and conditions (the Terms) set out the rules for using the AsiaTrip.pl website (the Service) and the conditions for booking and providing the tourist services offered by AsiaTrip (the Organiser). AsiaTrip provides tour and travel event organisation services in accordance with the laws of Poland, the European Union and the Kingdom of Thailand, particularly the Act of 24 November 2017 on Package Travel and Linked Travel Arrangements and the corresponding EU and Thai regulations.
- AsiaTrip is the organiser of tourist services and provides them in its own name. Depending on the offer, AsiaTrip may act as the organiser of a package travel arrangement or as an intermediary (agent) presenting offers from third parties. Most tours and programmes, however, are delivered directly by AsiaTrip (the Organiser) in cooperation with local partners. Where AsiaTrip acts solely as an intermediary, the contract for tourist services is concluded directly between the Client and the external service provider, and AsiaTrip is not responsible for providing those external services, except for obligations imposed by law. Each offer will state whether AsiaTrip is the direct organiser or only an intermediary for the relevant service.
- For the purposes of these Terms, a Client is a natural person with full legal capacity (or acting with the consent of a legal guardian), or a legal person or organisational unit that uses the Service and books the services offered. By registering with the Service and making a booking, the Client confirms that they have read and accept all provisions of these Terms.
- Using the Service and AsiaTrip’s services requires a user account and internet access. The Client agrees to use the Service as intended and in accordance with the law. When booking on their own behalf or on behalf of others, the Client declares that they are authorised to act on behalf of those people or are an authorised group organiser; otherwise, the Client accepts full responsibility for any lack of such authority. A person booking for more than one participant also accepts these Terms on behalf of all other participants listed in the booking, agrees to inform them of the participation conditions and must ensure that all participants comply with them.
- AsiaTrip declares that it holds all permits and licences required by law to organise package travel arrangements. Its business is conducted in accordance with the requirements of the TAT (Tourism Authority of Thailand) for tour operators in Thailand and the relevant requirements of Polish regulatory authorities for entities offering services to clients in Poland. AsiaTrip also provides financial protection for its clients in the event of insolvency (for example, in the form of an insurance guarantee or participation in the Travel Guarantee Fund), in accordance with the requirements of the Package Travel Act. This guarantees travellers a refund of payments if the Organiser becomes insolvent.
- Content presented in the Service, including tour descriptions, photographs and programmes, belongs to AsiaTrip or its partners and is protected by copyright. It may not be copied or used without the owner’s consent. Prices shown in the Service are gross prices, inclusive of taxes, and are stated in the currency indicated for the offer (PLN by default unless otherwise specified). AsiaTrip reserves the right to correct obvious typographical errors in offer descriptions and prices, but such corrections do not affect contracts already concluded.
Scope of AsiaTrip’s Services
- AsiaTrip specialises in organising tours, holidays and travel events in Asia, with a particular focus on Thailand and the countries of Southeast Asia. As part of its business, AsiaTrip prepares comprehensive travel packages that may include:
- Transport, including international and domestic flights, airport transfers, local transport and more.
- Accommodation, including bookings at hotels, resorts, guesthouses or other accommodation in accordance with the tour programme.
- Sightseeing and attractions programme, organisation of touring itineraries and optional local excursions, admission tickets to tourist attractions, guides (including coordination by AsiaTrip where provided) and other attractions included in the offer.
- Other tourist services, such as the services of a tour leader, travel insurance where included in the price, meals in accordance with the programme, and more.
- As a rule, AsiaTrip acts as the Organiser of the package travel arrangement, meaning that AsiaTrip is directly responsible to the Client for providing all elements of the travel package. AsiaTrip works with locally licensed guides, transport companies, hotels and other subcontractors, but remains responsible to the Client for the proper provision of the services covered by the contract, under these Terms and applicable law.
- In some cases, AsiaTrip may offer through the Service individual tourist services provided by partners (such as local attractions, courses or tickets) or independent products (such as vouchers or insurance). In those cases, AsiaTrip acts as a travel agent, presents the offers and intermediates the conclusion of a contract between the Client and the relevant service provider. AsiaTrip’s responsibility is then limited to presenting the offer accurately and carrying out its intermediary activities; the provider is directly responsible for delivering the service itself. External partner services are always identified in the offer description, for example by naming the provider. Use of these services is voluntary and may require acceptance of the provider’s terms and conditions.
- Each offer published in the Service includes a description of the material conditions of the package travel arrangement or service, including the programme, services included in the price, minimum number of participants where applicable, price and payment currency, information about required documents, vaccinations or visas where known, and any additional special conditions. Before booking, the Client should read the offer carefully to make sure the tour or service meets their expectations and needs. If in doubt, the Client is advised to contact AsiaTrip before placing a booking.
- Offers published in the Service may be updated. AsiaTrip endeavours to keep the information in the Service accurate and up to date. If outdated information or obvious errors appear due to a technical issue or mistake, for example regarding a price or departure date, AsiaTrip reserves the right to correct them. If an error concerns material conditions of a package already booked by the Client, the Client will be informed without delay and may choose either to accept the corrected conditions or receive a full refund of the amounts paid, in accordance with the procedure for changes described later in these Terms.
Registration and User Account
- Booking tourist services through the Service requires an active user account. The Client may create an account free of charge by providing the required details, including their first name, surname, email address and password, and accepting these Terms and the Privacy Policy. An account can be created during the first booking process, using the details provided for the booking, or separately through the registration form on the website.
- The Client must provide truthful and up-to-date information during registration and update it if it changes. Each person may have only one account with the Service. An account is personal and may not be shared with third parties, including its login and password. The Client is responsible for all activities carried out using their account. AsiaTrip is not responsible for the consequences of the Client disclosing their account password to a third party. If the Client suspects that their login details have fallen into the wrong hands, they should change their password immediately and notify AsiaTrip.
- Creating an account constitutes entering into a contract for the provision of electronic services relating to account maintenance for an indefinite period. The Client may delete their account at any time by submitting a request to AsiaTrip, for example by email. However, deleting an account while booked services are being provided, before the package travel arrangement has ended, may prevent the booking from being handled properly. In that case, the Client is advised to delete the account only after taking the tour or cancelling it in accordance with the conditions set out in these Terms.
- Through their user account, the Client can access their booking and payment history, manage participant details, submit comments and communicate with AsiaTrip’s customer service team. Details of how the Client’s personal data is processed in connection with the user account are set out in the Privacy Policy (see the Personal Data Protection section below).
Booking Services (Contract Conclusion Procedure)
- Placing a booking: The Client makes a booking by selecting a tour or tourist service of interest from the offers available on AsiaTrip.pl. The booking process uses the Service’s functionality to add the selected offer to the booking cart. The Client then completes the booking form, providing the required details for participants, including first and last names as shown on their identity document or passport, dates of birth, contact details and other information; selects any available extras, such as additional attractions, a higher room standard or insurance; and confirms their selections. Before submitting the order, the Client can check all the information entered, the services selected and the total price.
- Submitting a booking by clicking the order completion button, such as “Book” or “Place order with obligation to pay”, constitutes a binding offer to enter into a contract for tourist services with the Organiser on the conditions set out in the offer and these Terms. The Client must ensure that all booking details are correct. By placing a booking, the Client confirms that they hold the documents required for travel, such as a valid passport and visas, and meet the conditions for taking part in the package, such as being in a state of health that allows them to participate in the tour, where applicable.
- Booking acceptance confirmation: After receiving a booking, AsiaTrip will promptly, usually within 1 to 2 business days and no later than 48 hours, check availability and whether the offer can be provided based on the details submitted. If the check is successful, AsiaTrip will send a booking confirmation to the Client at the email address provided. It will contain the material terms of the contract, including details of the services ordered, dates of service, price, required deposit and schedule for payment of the balance, where applicable, as well as a unique booking reference and payment details. The Client will also receive a current copy of these Terms and the Participation Conditions, if issued separately, with the confirmation, either as an attachment or via a link.
- If, for any reason, the booking cannot be provided as proposed, for example because no places are available or supplier prices have changed, AsiaTrip will contact the Client to propose revised conditions, such as a different date or price, or inform them that the booking cannot be confirmed. If the Organiser cannot accept the submitted offer (booking) and confirm the trip, any deposit already paid will be refunded to the Client without delay, and the booking will be cancelled at no cost to the Client.
- If the Client does not receive a booking confirmation within 48 hours of placing the booking, this may indicate a technical problem with communications. In that case, the Client is asked to contact AsiaTrip again, for example by email or telephone, to check the booking status.
- Conclusion of the contract: The contract for the provision of tourist services is concluded when AsiaTrip sends the booking confirmation to the Client, on the conditions set out in the confirmation, the offer and these Terms. Maintaining the booking and keeping the contract fully valid requires the Client to pay the required deposit by the specified deadline. The payment rules are set out in the next section of these Terms. Failure to pay the deposit on time will be treated as the Client withdrawing from the contract before the start of the package due to the Client’s fault (cancellation). This may result in the booking being cancelled and costs being charged in accordance with the rules in the Cancellations and Refunds section.
- Participant details: The Client placing the booking must provide complete and accurate details for every traveller, matching the details in their identity documents (passport or identity card). These details are required to book flights and hotels and provide the remaining services. If the personal details in a booking do not match the travel documents, for example due to a misspelling of a first or last name, the carrier or another service provider may refuse to provide the service. The Client bears all consequences of such a situation, and payment for services not used for this reason is non-refundable. The Organiser will make reasonable efforts to help correct inaccurate details, for example by changing the name on a ticket, but this may involve additional costs, such as airline ticket name change fees, which will be charged to the Client.
- Travel documents: The Client and all participants in the tourist event must hold valid documents authorising them to cross borders and enter the destination country and any transit countries (a passport valid for at least 6 months from the return date, required visas, permits, vaccination certificates, negative test results, etc., as required). The Client is responsible for finding out which documents are needed for the trip and obtaining them. AsiaTrip may provide general information and guidance on passport and visa requirements, but travellers are responsible for carrying the required documents. Failure to hold valid documents or meet entry requirements (for example, being denied entry by border officials) will make participation in the event impossible and will be treated as a withdrawal attributable to the Client, with no right to a refund.
- Special needs and requests: If the Client has any special requests or needs (for example, a special diet or accessibility arrangements for a person with a disability), these should be reported before booking or, at the latest, in the booking form. AsiaTrip will endeavour to accommodate reported needs where possible, but does not guarantee that they can be met unless this has been expressly confirmed. Special requests confirmed in writing by AsiaTrip become part of the contract and will be fulfilled; failure to fulfil them entitles the Client to appropriate claims. Requests that have not been confirmed or are made at the last minute are treated as information only, and failure to meet them cannot be grounds for a complaint.
Payments
- Price of the tourist event and deposit: Each offer specifies the price of the tourist event or service and the currency in which payment must be made. When confirming the booking, the Organiser will state the amount of the required deposit (part of the price) and the payment deadline. The deposit is intended to cover the cost of booking key elements of the trip (for example, flights, accommodation, transfers and admission tickets) and is usually between 20% and 50% of the event price (the exact amount depends on the nature of the offer and the booking date). In some cases, for example, bookings made shortly before departure or promotional offers, full advance payment may be required. Information about the required deposit or full payment will be clearly stated in the booking confirmation.
- Payment methods: AsiaTrip accepts payments by bank transfer (traditional or electronic) and through Revolut. The Client may pay into a designated bank account belonging to AsiaTrip (in Poland or a foreign currency account) or use Revolut, for example, by transferring funds to the Organiser’s Revolut phone number or account, or by scanning a Revolut QR code provided by AsiaTrip. Payment details, including bank account numbers in PLN and, where applicable, other currencies, will be provided to the Client in the booking confirmation or through the Service’s transaction system. Revolut payments are treated in the same way as ordinary bank transfers. AsiaTrip does not currently accept cash, credit card payments directly on the website, or cash on delivery. Available payment methods are limited to bank transfers and Revolut transfers (and any other methods agreed individually, if AsiaTrip offers them).
- Payment deadlines: The Client must pay the deposit by the deadline stated in the booking confirmation (normally within 2-7 days of receiving the confirmation; for last-minute bookings, the deadline may be shorter, for example, 24 hours). If the deposit has not been credited to the Organiser’s account by the specified deadline, the booking will be cancelled automatically, and the contract will be considered not concluded or terminated due to the Client’s fault, of which the Client will be informed. The balance, bringing the total paid to 100% of the event price, must be paid no later than 30 days before the event start date, unless a different schedule is specified in the booking confirmation. For bookings made less than 30 days before departure, the deadline for paying the full price may be shorter or payment may be due immediately. The Client will be informed of the schedule and deadlines for any further instalments in each case. Failure to pay subsequent instalments (the balance) on time entitles the Organiser to treat this as the Client’s withdrawal from the contract and cancel the booking, charging the Client cancellation costs (at least the amount of the deposit already paid, in accordance with the rules in the Cancellation and Refunds section).
- Payment confirmation: Each payment made by the Client should include a payment reference that identifies the booking (for example, the booking number or the Client’s surname and event date). Once the payment has been credited, AsiaTrip will send the Client confirmation that it has been received (by email or through the messaging system in the user account). The Client is asked to retain proof of the transfer until confirmation is received from the Organiser. If confirmation is delayed (for example, if the Client has not received notification that the payment was credited within 7 days), the Client should contact AsiaTrip and may be asked to provide proof of the transfer so the matter can be clarified.
- Exchange rates and bank charges: If the event price is stated in a foreign currency (for example, THB, USD or EUR), payments may be made in that currency or in PLN at the conversion rate provided by the Organiser. AsiaTrip may specify a preferred exchange rate or foreign currency account to avoid exchange rate risk for both parties. The Client is responsible for all bank charges for transfers, particularly international transfers. The Client is advised to check any applicable charges with their bank before making payment. The Organiser will confirm the amount received in the relevant currency and the exchange rate calculation in the payment confirmation.
- Full payment and vouchers: Once full payment (100% of the price) has been received before the event begins, AsiaTrip will provide the Client with all documents needed for travel, such as flight tickets, hotel vouchers, transfer and tour vouchers, and insurance documents (if purchased). These documents may be provided electronically (by email or through the user account) or in person at the event starting point, as stated in the booking confirmation.
- Failure to pay: Failure to comply with the payment terms (for example, failure to pay the remaining balance by the deadline) will be treated as the Client’s unilateral withdrawal from the contract. In this case, AsiaTrip is entitled to cancel the booking and charge the Client cancellation costs in accordance with the Cancellation and Refunds section below. In practice, this means at least forfeiting the deposit already paid to cover expenses incurred by the Organiser.
- Price changes after the contract is concluded: The price agreed in the contract is, as a rule, fixed and will not change. As an exception, AsiaTrip reserves the right to change the price of the tourist event after the contract is concluded, solely in the cases permitted by law (under Article 45 of the Act on Tourist Events), namely if there are:
- significant changes in transport costs (for example, the price of aviation fuel),
- changes in taxes or official, airport, border or visa fees,
- significant exchange rate fluctuations that affect the costs of delivering the event.
Any price increase may be made no later than 20 days before departure and may not exceed 8% of the total event price without the Client’s consent. The Client will be informed promptly of any planned price increase, together with the reasons for it. If the proposed increase exceeds 8% of the price, the Client is entitled to withdraw from the contract without incurring any costs (and receive a full refund of payments made) or accept the price change. A reduction in costs for the same reasons, for example, a decrease in taxes, entitles the Client to request a price reduction, although the Organiser may deduct the actual costs of processing the corresponding refund. This clause applies in accordance with the applicable laws. If, under the law in force at the time, a price change after the contract has been concluded is not permitted, this clause will not apply.
Client obligations and liability
- Compliance with laws and instructions: The Client (and all participants covered by the booking) agrees to comply with local laws during the trip and to follow the instructions and guidance of the Organiser’s representatives (tour leaders, guides) and the staff of cooperating companies (for example, drivers). In particular, participants must follow safety rules while the itinerary is being carried out (for example, venue rules, instructions for using equipment, swimming and diving rules, and rules for extreme sports if these are part of the itinerary). Failure to follow the applicable rules may result in legal consequences at the Client’s own expense and, in extreme cases, exclusion from the remainder of the event without the right to claim a refund for unused services.
- Health and travel insurance: The Client declares that their health and that of the other participants listed in the booking allows them to take part in the selected tourist event. If in doubt, they should consult a doctor before travelling. All participants should independently purchase appropriate travel insurance, covering medical expenses abroad, personal accident insurance, and cancellation insurance for the event (if they wish to protect themselves against having to cancel their participation). The Organiser may act as an intermediary in purchasing cancellation insurance on the date the contract is concluded, if this option is available, and will offer it to the Client. AsiaTrip may provide basic personal accident insurance for the duration of the tourist event if required by local regulations (for example, tourist insurance is required during excursions in Thailand). Details of any such insurance, including its scope and insured sums, will be given in the offer or booking confirmation. Note: Any insurance provided by the Organiser covers only incidents that occur while the itinerary is being carried out and generally does not include individual health, transport or cancellation insurance. The Organiser is not liable for any consequences of the Client’s failure to obtain appropriate insurance. We strongly recommend that travellers have personal travel insurance covering medical expenses, personal accidents and trip cancellation.
- Documents and entry requirements: As stated in the section on bookings, the Client is responsible for holding valid travel documents (passport, visa, tickets, etc.) and complying with border, customs, sanitary and other regulations in the countries they visit. AsiaTrip is not liable for the consequences of the Client’s failure to meet these requirements. If the itinerary requires special permits or formalities (for example, entry visas, permits to enter national parks or vaccination certificates), the Organiser will provide information about them in the offer description and may help obtain them, but the traveller remains ultimately responsible for holding them.
- Pregnancy, children and mobility limitations: The Client should inform AsiaTrip of any significant circumstances concerning participants that may affect the event, such as pregnancy, chronic illness, disability or limited mobility, or the ages of children taking part in the tour. This information will help adapt the itinerary or confirm whether a person can participate. AsiaTrip reserves the right to refuse a place on a tour to anyone whose health or special needs prevent the itinerary from being carried out safely, if suitable arrangements cannot be provided (for example, where a route has no facilities for people with disabilities). Such refusal may be made only for valid safety reasons or because the service is incompatible with the person’s needs. In that case, the Client will receive a refund of payments made, provided they accurately disclosed their needs at the booking stage.
- Liability for damage: The Client is financially liable for any damage they cause through their own fault during the trip, for example, damage to hotel furnishings, a means of transport or equipment hired during the tour. The Organiser is not liable for damage caused by the Client or participants to third parties. Any claims arising from such damage are the responsibility of the person who caused it. The Client agrees to cover the costs of repairing damage or any fines imposed on them or the Organiser as a result of the Client’s conduct (for example, traffic fines).
- Complaints and problems during the trip: If the Client notices any failure to perform the contract (for example, services that do not match the offer or problems with service quality), they should promptly inform the tour leader or AsiaTrip’s local representative so that the issue can be addressed during the trip. If reporting the issue during the trip does not resolve it, the Client is entitled to submit a formal complaint after returning. The complaint procedure is described in the Final Provisions section. Failure to report a problem during the event may affect the amount of any compensation, if earlier intervention could have prevented the loss or discomfort.
- Lost belongings and personal safety: The Client is responsible for looking after their own baggage and personal belongings during the trip. The Organiser is not liable for items belonging to participants that are lost or stolen during the event. Travellers are advised to take ordinary care, for example, by using hotel safes and not leaving belongings unattended. Participants should also look after their own safety by following the tour leaders’ guidance, for example, about places to avoid after dark and local customs.
Cancellation, withdrawal from the contract and refunds
- No statutory right of withdrawal (14 days): A Customer purchasing a package tour or linked travel arrangements does not have the right to withdraw from the contract within 14 days of its conclusion, as provided for in the Act of 30 May 2014 on Consumer Rights. Under Article 38(12) of that Act, the right of withdrawal does not apply to contracts for services related to leisure, entertainment, tourism or cultural events if the contract specifies the date or period when the service is to be provided. This means that once a booking has been confirmed, the Customer cannot unilaterally withdraw from the contract without cost during a “cooling-off period”. Any terms for cancelling the package tour by the Customer are governed exclusively by the provisions of these Terms and Conditions and specific tourism laws.
- Cancellation by the Customer (withdrawal before the package tour starts): The Customer has the right to cancel their participation in a package tour at any time before it starts by submitting an appropriate statement on a durable medium (written form is preferred, by email to AsiaTrip or by registered post). However, the Customer must cover the costs incurred by the Organiser in preparing the package tour. Since AsiaTrip commits funds (deposits) to bookings for attractions, hotels, flights and transfers immediately after confirming a booking, any amounts paid by the Customer are non-refundable if the Customer cancels. The “no refunds” policy means that:
- The deposit paid by the Customer is non-refundable from the moment it is paid. It is used to cover expenses related to organising the package tour (purchasing airline tickets, hotel bookings, etc.) and is forfeited in full to the Organiser if the Customer cancels.
- If the Customer has also made an additional payment (partial or full) above the deposit amount, that amount is also generally non-refundable. Where possible, the Organiser will try to recover unused funds from subcontractors (for example, whether a hotel will refund part of the amount for a cancelled stay or an airline will refund airport taxes for an unused ticket), but does not guarantee any refund. Any refund of unused funds or amounts recovered from suppliers may be made to the Customer, after deducting costs incurred and handling fees, solely at the Organiser’s discretion and does not constitute an obligation.
- Cancellation close to the departure date (for example, 7 days or less before the package tour starts) usually means that 100% of the package tour price has already been spent and lost, and in practice no refund of any kind is possible.
- No exceptions to the cancellation rules: The no-refunds policy applies regardless of the reason for cancellation. This means the Organiser makes no exceptions even in extraordinary circumstances affecting the Customer, such as illness, an accident, family complications or other personal misfortunes. Circumstances often described as force majeure on the Customer’s part (for example, sudden events preventing departure or unforeseen events involving the Customer) also do not entitle the Customer to request a refund. In such cases, only cancellation insurance held by the Customer may allow them to recover some of the costs incurred, in accordance with the insurer’s policy terms. AsiaTrip does not offer its own compensation fund and does not make exceptions to the no-refunds rule, even for humanitarian reasons. It is therefore important to consider purchasing appropriate insurance and to make a booking decision carefully.
- Changing a participant (transferring the contract to another person): If the Customer who entered into the contract cannot personally take part in the package tour and intends to cancel, they may propose another person to take their place, provided that person meets the participation requirements (for example, passport and visa requirements and health requirements). Notice of a change of participant should be given within a reasonable time before the package tour starts (at least 7 days before departure where possible, or as specified in the offer terms). AsiaTrip will agree to the change of participant if permitted by subcontractors (for example, the airline must allow the name on the ticket to be changed). The original Customer and the new participant are jointly and severally liable for any additional costs of the change (for example, ticket change fees or amending a hotel booking) and any difference in the package tour price (for example, if changing the participant requires changing the room arrangement from single to double occupancy). Once the transfer of the booking to the new person is confirmed, the former Customer is not entitled to a refund of any payments. The contract is deemed to continue, with only the person entitled to the services having changed. The new participant assumes the Customer’s rights and obligations towards the Organiser.
- Withdrawal by the Customer for reasons beyond their control (force majeure at the destination): Under applicable law, a Traveller (Customer) has the right to withdraw from a contract for participation in a package tour before it starts without paying a cancellation fee if unavoidable and extraordinary circumstances occur at or near the package tour destination, such as a serious armed conflict, natural disaster or another situation that threatens safety and makes it impossible to carry out the package tour. Whether such circumstances have occurred will be assessed on the basis of official notices issued by the relevant authorities (for example, travel advice from the Ministry of Foreign Affairs). In such a case, the Customer is entitled to a full refund of payments for the package tour, but not to additional compensation. This follows from applicable law (Article 47(4) of the Package Travel Act) and is the only exception to the Organiser’s general no-refunds policy. Note: Withdrawal on force majeure grounds applies to events at the place where the package tour is carried out, not to personal misfortunes affecting the Customer (these do not entitle the Customer to withdraw without cost; see item 3 above).
- Cancellation of the package tour by the Organiser: AsiaTrip will make every effort to ensure that each confirmed package tour goes ahead. However, the Organiser reserves the right to cancel a package tour before it starts in the following cases:
- the minimum required number of participants is not reached, if a minimum number was specified in the offer (the Organiser will give notice of cancellation for this reason no later than 20 days before a package tour lasting more than 6 days, 7 days before a package tour lasting 2 to 6 days, or 48 hours before a one-day package tour),
- force majeure or other extraordinary circumstances make it impossible to carry out the package tour safely (for example, natural disasters, riots, government decisions closing borders or epidemics),
- another significant reason attributable to the Organiser (for example, the tour leader becomes ill and no replacement can be arranged, or a subcontractor becomes insolvent).
If a package tour is cancelled for any of the reasons above, the Customer will receive a full refund of payments made within 14 days of the cancellation. Alternatively, AsiaTrip may offer the Customer a replacement package tour of the same or a higher standard, if available. The Customer may accept the offer or request a refund. However, the Customer is not entitled to additional compensation or damages if the cancellation was due to:: an insufficient number of bookings, provided the Organiser met the required notice deadlines,
: force majeure or extraordinary circumstances that could not have been foreseen or prevented.
In other cases where the Organiser is at fault (for example, an error on our part), the Customer may be able to claim damages under the general rules (liability is typically limited to twice the package tour price, in accordance with the Act, unless the law provides otherwise).
- Failure by the Customer to use services: If the Customer does not use all or part of the paid services on their own initiative or for reasons attributable to them (for example, missing a flight through their own fault, opting out of part of the programme during the package tour, shortening their stay or being excluded from the package tour for breaching the rules), they are not entitled to a refund for the unused elements of the package tour. Where possible, the Organiser may help the Customer arrange an earlier return or alternative services, but the Customer must cover all related additional costs.
- Cancellation procedure: The Customer should submit a cancellation (withdrawal) from the contract in writing, preferably by emailing a statement to the AsiaTrip contact address given on the Website or by registered post. The cancellation date is the day the Organiser receives the Customer’s statement. AsiaTrip will confirm receipt of the cancellation. Within 14 days, the Organiser will then provide the Customer with an account of cancellation costs and the amount of any refund, if one is due under the rules above, or confirm that no refund is due. If the Customer has paid only a deposit and cancels before paying the balance, the deposit being non-refundable means that no further instalments will be pursued (unless specific terms provide otherwise). If the package tour was purchased on credit or financed using a voucher or external funds, the account will be settled in accordance with the terms of those instruments (for example, the voucher may expire).
Changes to the programme and the Organiser’s liability
- Minor changes to the programme: The Organiser reserves the right to make minor changes to the package tour that do not materially affect its nature or the scope of services. Minor changes include, for example, changing the order in which places are visited, replacing a hotel with another of a similar standard, adjusting departure times due to flight schedules or road conditions, or changing to an airline of a comparable standard. Such changes may be made to optimise the trip or due to objective factors (weather, road conditions, etc.) and do not constitute failure to perform or improper performance of the contract, and therefore do not provide grounds for a complaint or withdrawal from the contract by the Customer.
- Extraordinary circumstances and programme changes: If unavoidable and extraordinary circumstances arise during or shortly before the package tour (for example, a sudden deterioration in weather, a typhoon or flood; a tourist attraction being closed by government decision; a general strike bringing transport to a standstill; or force majeure), AsiaTrip may have to make more significant changes to the programme, or even cancel or interrupt the package tour while it is in progress. In such a situation, the Organiser undertakes to provide assistance and ensure the Customers’ safe return to the place where the package tour began, or another agreed location, and to offer alternatives where possible. If a change concerns material terms of the contract (for example, a lower standard of accommodation or omission of a key programme item), the Customer will be informed and has the right to take part in the proposed replacement package tour free of charge, if one is offered, or request a price reduction proportionate to the reduced value of the services, or, if the change significantly affects the nature of the package tour, withdraw from the contract and receive a refund of payments made. The choice among these options depends on the scale and timing of the change and the applicable law (Article 46 of the Package Travel Act sets out the traveller’s rights if the organiser changes the contract). The Customer should inform the Organiser of their decision promptly after receiving notice of the changes.
- Changes for reasons attributable to local suppliers: AsiaTrip uses local contractors (for example, carriers and venue owners). In rare cases, a contractor may fail to perform its contract (for example, an airline may cancel a flight, a hotel may close or a coach may break down). Acting as a professional organiser, AsiaTrip will make every effort to provide a replacement service of a comparable standard (for example, arrange alternative transport or accommodation at a property of no lower standard). Such measures are treated as performance of the Organiser’s obligations by alternative means and do not provide grounds for claims, provided the final scope of services is equivalent to the original. However, if certain elements of the programme cannot be delivered or replaced for reasons beyond the Organiser’s control (for example, a boat trip to an island is cancelled due to bad weather and no alternative activity is available), the Organiser may, but is not required to, grant Customers appropriate compensation, such as a partial refund of the cost of the unused attraction or a discount voucher for future services. Each such case will be considered individually, taking into account the limitations arising from force majeure.
- Organiser’s liability for failure to perform or improper performance of the contract: Under applicable law, AsiaTrip is liable to the Customer for the delivery of the agreed travel services, unless the failure to perform or improper performance is caused exclusively by:
- an act or omission by the Customer (for example, the Customer changed the arrangements themselves, failed to attend the meeting point or breached the rules),
- an act or omission by a third party not involved in providing the travel services, if the act could not have been foreseen or avoided (for example, sudden government decisions, border closures or local authorities cancelling public events),
- force majeure, meaning extraordinary circumstances beyond the parties’ control.
In the situations above, AsiaTrip will make efforts to help the Customer (for example, arrange a return journey or obtain replacement services), but formally is not liable for damages resulting from the cancellation or changes to a package tour for those reasons. In particular, AsiaTrip is not liable for loss or damage suffered by the Customer because a trip did not take place due to force majeure (as defined in the Civil Code) or other reasons beyond AsiaTrip’s control, for example, an airline strike, closure of airspace or a pandemi.
- Limitation of financial liability: Any liability of AsiaTrip for damages arising from improper performance of the contract, unless excluded above, is limited to a maximum of three times the total price of the package tour for each Customer, in accordance with Article 50(2) of the Package Travel Act, unless the damage involves personal injury or loss of life of the Customer or was caused intentionally or through gross negligence. In those cases, liability is not contractually limited. In addition, any compensation or damages due for a carrier’s failure to perform or defective performance of services (for example, compensation for a delayed flight under Regulation (EC) No 261/2004 or compensation for lost baggage under the Montreal Convention) reduces AsiaTrip’s liability to the same extent. That is, if the Customer has received compensation from an airline, for example, they cannot claim compensation from AsiaTrip a second time for the same reason.
- Transport delays and disruptions: The Organiser is not liable for delays to public transport (air, rail or bus) caused by technical problems, weather conditions or administrative decisions (for example, an airport closure). Where possible, AsiaTrip will assist Customers in obtaining benefits due to them from carriers (for example, meals or accommodation during a long flight delay) and in rearranging the tour programme, but does not pay compensation for delays not caused by the Organiser. Similarly, AsiaTrip is not liable for missed connections (for example, missing a transfer) for reasons attributable to carriers or where the Customer independently arranged part of their journey independently of the AsiaTrip offer.
- Customer’s participation in the package tour: The Customer must arrive on time for meeting points, check-in and the start of each programme item. If the Customer is late or fails to show up for a flight, transfer or tour, the Organiser will try to help them join the group later in the package tour, but the Customer must cover all related costs. The Organiser does not refund the cost of unused tickets or services missed because the Customer was late. Customers are advised to stay in contact with the AsiaTrip tour leader or representative (for example, by phone) during the package tour so that any difficulties (such as finding the meeting point) can be addressed promptly.
- Technical condition and inconveniences: AsiaTrip is not liable for temporary inconveniences that may occur during a trip and are beyond the Organiser’s control, for example, temporary disruption caused by hotel renovation (if the hotel provides equivalent replacement services), street noise in public places, weather conditions affecting comfort (heat, rain), insects in the tropics, etc. These factors are beyond the Organiser’s control, inherent in the nature of travel, and do not provide grounds for a complaint, provided the Organiser exercised due care in selecting reputable service providers and gave accurate information about travel conditions.
Promotions, discounts and vouchers
- AsiaTrip may offer special prices, group discounts or discount codes for selected services or during specific periods. Details of current promotions are provided each time in the offer description (tour programme) or on the Website homepage. Promotions may be limited by time or quantity (for example, to a specified number of initial bookings).
- Group discounts: AsiaTrip generally offers discounts to organised groups. For example, a one-time booking for a group of at least 5 people may qualify for a per-person discount or one additional person may participate free of charge, depending on the offer. The specific terms for group discounts (discount percentage, minimum group size, etc.) are described in the offer for each package tour. Group discounts are applied automatically during online booking if the booking system recognises that the conditions are met, or may be added manually by a consultant when confirming the booking.
- Children’s discounts: Family offers may include reduced prices for children within a specified age range. The child’s qualifying age is stated in the offer details (for example, “child up to 10 years old in an extra bed, 50% of the price”). The person making the booking should provide the child’s date of birth. The Organiser has the right to verify the child’s age before the package tour starts (for example, using a passport). If it is found that the child is older than declared and was not eligible for the discount, the Organiser may charge the difference up to the full adult price.
- Vouchers and discount codes: If the Customer has a valid AsiaTrip gift voucher or discount code, they may use it when making a booking by entering the code in the relevant form field. The discount is valid only if any specified conditions are met (for example, a minimum booking value or voucher expiry date). Vouchers cannot be combined with other promotions unless the terms of a particular promotion state otherwise. If a booking made using a voucher is cancelled, the voucher is considered used and cannot be used again or exchanged for cash.
- Last Minute and Early Booking promotions: AsiaTrip may offer “last minute” deals (booked shortly before departure, usually at a reduced price) and “First/Early Booking” promotions (discounts for those who book well in advance). The terms of these promotions, such as dates, discount amounts and payment terms, are provided each time in the offer description. Please note that promotional offers may be subject to special payment or cancellation terms (for example, a shorter deadline for paying the full amount or no option to change the booking without charge), which will be stated in their terms.
- Information about promotions: Any discounts or promotions due to the Customer will be included in the booking confirmation or pro forma invoice. If the Customer believes they meet the conditions for a promotion but the discount has not been applied, they should contact AsiaTrip before making payment, as promotional discounts will not be applied retroactively after the transaction is completed.
Personal Data Protection
- AsiaTrip is the controller of personal data provided by the Customer (the Organiser’s registration details are given in the General Provisions section or on the Website). The Customer’s and tour participants’ personal data are processed to perform the contract for travel services, manage the user account on the Website, and for contact, marketing and archiving purposes, in accordance with the scope of consent given and applicable data protection laws.
- AsiaTrip processes personal data in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and relevant Polish and Thai data protection laws (for example, the Personal Data Protection Act and Thailand’s Personal Data Protection Act). Detailed information about the purposes and legal bases for processing, recipients of data (for example, airlines and hotels, to the extent necessary to provide the services), and the rights of data subjects (right of access, rectification and erasure, right to object, right to data portability, and right to lodge a complaint with a supervisory authority) is set out in the Privacy Policy available on the Website. The Customer declares that they have read the Privacy Policy.
- Providing personal data when registering an account and making a booking is voluntary, but necessary to conclude and perform the contract. Refusing to provide required data or requesting its deletion before the package tour is carried out may make it impossible to provide the service. AsiaTrip is not liable for this, and it is treated in the same way as cancellation of the package tour by the Customer.
- The Customer’s personal data may be shared with entities involved in performing the contract, to the extent necessary to provide the services (for example, airlines receive passengers’ passport details, hotels receive guest lists, and insurers receive data for the policy). AsiaTrip requires its partners to keep the data confidential and secure it in accordance with applicable laws.
- AsiaTrip implements appropriate technical and organisational measures to protect Customers’ personal data against unauthorised access or disclosure. The Website uses secure transmission encryption (HTTPS/SSL) where appropriate. Access to the user account is protected by a password set by the Customer, who is responsible for keeping it confidential.
- Any questions about the processing of personal data, including the exercise of data subject rights, should be sent to the Organiser’s email address specified in the Privacy Policy or the contact address given on the Website.
Final Provisions
- Complaints: If the Customer considers that the services provided for in the contract were not properly performed or that there were any irregularities in the operation of the Website, the Customer has the right to submit a complaint. A complaint should be made in writing and may be sent by email to the AsiaTrip contact address or by post to the registered office address, if provided. Customers are advised to submit complaints promptly after the package tour ends, and, for complaints about the Website, within a reasonable time after discovering the issue. A properly submitted complaint should include the Customer’s details (first name, surname and contact information), booking number or other information identifying the contract, and a description of the concerns raised. AsiaTrip will consider the complaint within 14 days of receipt and respond in the same form in which it was received (the response will be sent to the email or postal address provided). In particularly complex cases requiring arrangements with foreign contractors, the review period may be extended. The Customer will be informed, and a response will be provided no later than 30 days. Regardless of whether a complaint is submitted, the Customer may pursue claims in court. Using the internal complaint procedure may help resolve the matter amicably.
- Contacting AsiaTrip: The Customer may send any questions, comments or correspondence about concluded contracts to AsiaTrip by email at kontakt@asiatrip.pl or another current address listed under “Contact” on the Website. For current booking matters, AsiaTrip may also be contacted by phone at the number given in the booking confirmation, if a helpline number is provided. AsiaTrip will make every effort to answer your questions as quickly as possible, usually within 1 to 2 business days.
- Changes to the Terms and Conditions: AsiaTrip may amend these Terms and Conditions for important reasons, in particular due to changes in the law or an expansion of the Website’s functionality. Registered users will be informed of any changes through a notice on the Website or by email. The amended Terms and Conditions will take effect on the date specified in the notice, which must be at least 14 days after notification. Bookings made before the amendments take effect are governed by the version of the Terms and Conditions in force when the booking was made, unless the law requires new provisions to apply immediately.
- Applicable law and disputes: Matters not covered by these Terms and Conditions are governed by the relevant provisions of Polish law, including the Civil Code and the Package Travel Act, and, for services provided electronically, the Act on the Provision of Electronic Services. AsiaTrip declares that it also complies with European Union consumer protection laws and tourism regulations in force in Thailand. However, Polish law governs contracts concluded through the Website. Any disputes between the Customer and the Organiser will be resolved amicably, or, if no agreement is reached, by the competent ordinary courts with jurisdiction over the subject matter and location. A Customer who is a consumer may also use out-of-court dispute resolution methods (ADR), such as mediation, the arbitration court at the Office of Competition and Consumer Protection, or the EU ODR platform.
- Acceptance of the Terms and Conditions: By using the Website and making a booking, the Customer confirms that they have read these Terms and Conditions, that all their provisions are clear and understandable to them, and that they undertake to comply with them. The current version of the Terms and Conditions is always available on AsiaTrip.pl under the “Terms and Conditions” link and may be read, downloaded or printed at any time.
- Additional provisions: If any provision of the Terms and Conditions is found invalid or ineffective by a final court judgment, the remaining provisions will remain in force, and the legal rules closest to the commercial purpose of the invalid provision will apply in its place. AsiaTrip’s failure to exercise a right under the Terms and Conditions in a particular case does not constitute a waiver of that right or create a precedent for the future.
- These Terms and Conditions in the above form are effective from [date of entry into force to be provided] and apply to contracts concluded from that date. Archived versions of the Terms and Conditions are available for inspection on request at AsiaTrip’s registered office or electronically.
